Terms of Service
These terms of service ("Terms") govern your access to and use of the products and services provided by The Still Architect, including The Refactor online course, The Friction Audit, our website, newsletter, and any related content or materials.
By purchasing The Refactor, signing up for The Friction Audit, subscribing to our newsletter, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
Eligibility: Our services are designed for adults. You must be at least 18 years of age to purchase The Refactor or use our services.
Privacy: Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
The Still Architect is operated by Dihan Pool as a sole trader based in Australia.

1. Australian Consumer Law
These Terms are subject to the Australian Consumer Law (ACL), which is Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL that cannot be excluded, restricted, or modified by agreement (as provided by section 64 of the ACL).
If our services fail to meet a consumer guarantee under the ACL, you are entitled to the remedies set out in the ACL. For a major failure (as defined in section 268 of the ACL for services, or section 260 for goods), this includes the right to cancel the service and receive a refund. For a minor failure, we may re-supply the service or remedy the issue within a reasonable time.
2. The Refactor - Course Access
2.1 What you receive
When you purchase The Refactor, you receive:
- Access to all video lessons across 7 modules (plus onboarding content) delivered through Thinkific
- Access to 24 personalised prompts hosted on Notion, accessible via links within the course
- Access to supplementary materials referenced within the course modules
- A completion certificate upon finishing the course
2.2 Licence, not ownership
Your purchase grants you a personal, non-exclusive, non-transferable licence to access and use the course content for your own personal and professional development. You do not acquire ownership of any course materials, intellectual property, or underlying content.
2.3 Lifetime access
"Lifetime access" means access for as long as The Refactor is available on the Thinkific platform. If we discontinue the course or change platforms, we will provide at least 90 days' notice and make reasonable efforts to ensure continued access or provide downloadable copies of the content.
2.4 Account responsibility
You are responsible for maintaining the security of your Thinkific account credentials. You must not share your login details or provide access to the course to any other person. One purchase grants access to one individual.
3. Pricing and Payment
3.1 Pricing
Current pricing is displayed on the landing page at the time of purchase. Founding member pricing ($97) is available for a limited number of spots, after which the standard price ($297) applies. All prices are in USD.
All prices include GST where applicable under Australian tax law.
3.2 Payment processing
Payments are processed securely by Stripe (Stripe, Inc.). We do not store your full credit card details. By making a purchase, you also agree to Stripe's terms of service and privacy policy.
3.3 No payment plans or discount codes
The Refactor is offered at a single price point with no instalment plans, coupon codes, or promotional discounts.
4. Refund Policy
Our refund policy is set out in a separate document: Refund Policy.
In summary:
- We offer a 30-day money-back guarantee on The Refactor. If you are not satisfied, email us within 30 days of purchase for a full refund.
- This guarantee operates in addition to, and does not affect, your statutory rights under the Australian Consumer Law.
5. Intellectual Property
5.1 Our content
All content within The Refactor, The Friction Audit, our website, newsletter, and associated materials is protected by the Copyright Act 1968 (Cth) and applicable international copyright laws. This includes but is not limited to:
- Video lessons, scripts, and slide presentations
- Prompt text and prompt design
- Written content, articles, and frameworks
- Visual assets, logos, and branding
- Course structure and curriculum design
"The Still Architect", "The Refactor", and "The Friction Audit" are trade names of the business.
5.2 What you may do
- Access and use course content for your own personal and professional development
- Use the outputs generated by the prompts (e.g., your Biological Blueprint, your Default Calendar) - these outputs belong to you
- Reference concepts from the course in conversation, provided you do not reproduce substantial portions of the content
5.3 What you may not do
- Copy, reproduce, distribute, or republish course materials (including videos, scripts, prompts, and slides) in any form
- Share course access credentials with others or allow others to access your account
- Use course content to create competing products or services
- Record, download, or capture course videos beyond what the platform permits
- Remove or alter any copyright notices or attributions
5.4 Your outputs
Any personalised outputs you generate using the course prompts (your Biological Blueprint, System Audit, Default Calendar, Input Scorecard, Recovery Architecture, Maintenance Protocol, etc.) belong to you. We claim no ownership of your prompt outputs.
6. The Friction Audit and Free Content
6.1 The Friction Audit
The Friction Audit is a free resource. By signing up, you provide your email address and consent to receive follow-up communications related to The Still Architect. You can unsubscribe at any time.
6.2 Newsletter
By subscribing to our Substack newsletter or Beehiiv email list, you consent to receive periodic emails. You can unsubscribe at any time by clicking the unsubscribe link in any email.
7. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorised access to our systems, the Thinkific platform, or other users' accounts
- Interfere with or disrupt the operation of our services
- Use automated tools (bots, scrapers) to access or extract content from our services
- Misrepresent your identity or affiliation when using our services
We reserve the right to suspend or terminate your access if you breach these Terms, subject to providing reasonable notice where practicable.
8. Disclaimers
8.1 Educational content, not professional advice
The Refactor and all associated content is educational in nature. It is not a substitute for professional medical advice, psychological counselling, legal advice, or financial advice. The course discusses topics including stress, sleep, burnout, and cognitive performance in an educational context drawing on published research. If you are experiencing a mental health crisis, please contact a qualified health professional or crisis service.
8.2 Results not guaranteed
Individual results vary. The course provides frameworks, tools, and prompts to help you redesign your operating environment. The outcomes you achieve depend on your individual circumstances, engagement with the material, and implementation of the concepts. We do not guarantee specific results.
8.3 Third-party tools
The course prompts are designed for use with AI tools such as Claude (Anthropic) and ChatGPT (OpenAI). These are third-party services with their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or performance of third-party AI tools. Your use of those tools is governed by their respective terms.
9. Limitation of Liability
To the maximum extent permitted by law (and subject to section 1 above regarding ACL consumer guarantees that cannot be excluded):
- Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of our services is limited to the amount you paid for The Refactor.
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- We are not liable for any loss or damage resulting from circumstances beyond our reasonable control, including but not limited to third-party platform outages (Thinkific, Stripe, Notion), internet connectivity issues, or changes to third-party AI tools.
This limitation does not apply to liability that cannot be limited or excluded by law, including liability under the ACL for goods or services that fail to meet consumer guarantees, or liability for fraud or wilful misconduct.
10. Dispute Resolution
If you have a dispute or complaint about our services:
- Contact us first. Email thestillarchitect@gmail.com and describe the issue. We will respond within 7 business days and work in good faith to resolve the matter.
- Mediation. If we cannot resolve the dispute directly, either party may refer the matter to mediation administered by the Resolution Institute (formerly LEADR & IAMA) or a similar accredited mediation service in New South Wales, Australia.
- Applicable law. These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any disputes arising under these Terms.
Nothing in this clause limits your right to bring a claim before the relevant consumer protection body, including the Australian Competition and Consumer Commission (ACCC) or your state or territory fair trading office. Nothing in this clause prevents you from relying on the mandatory consumer protection laws of your country of residence.
For customers in the European Union
Under the Consumer Rights Directive (2011/83/EU), you may have a 14-day right of withdrawal for distance purchases. For digital content, Article 16(m) of that Directive provides that this right does not apply once performance has begun with your prior express consent and acknowledgement that you lose the right of withdrawal. By accessing the course content after purchase, you consent to immediate delivery and acknowledge the loss of withdrawal rights. Our 30-day money-back guarantee (see section 4) provides broader protection than the statutory withdrawal period.
11. Modifications to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last updated" date at the top of this page
- We will notify existing customers by email where the changes materially affect their rights or obligations
- Changes will not apply retrospectively to purchases made before the change
- If you do not agree with a material change that adversely affects your rights, you may notify us within 30 days of the notification. We will either continue to provide the services under the previous Terms or, if that is not practicable, offer a refund of the purchase price
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and The Still Architect regarding your use of our services, and supersede any prior agreements or understandings.
